SALE CONDITIONS
These general conditions of sale (the "General Conditions") govern the terms and conditions of sale of the products marketed by TUNINETTI PNEUMATICI SRL (the "Products").
All contracts for the sale of Products by TUNINETTI PNEUMATICI SRL to third parties (the "Customers") are governed by these General Conditions, which form an integral and substantial part of each proposal, order and confirmation of the purchase order of the Products themselves.
The sales conditions applicable to your order are those in force on the date of the order.
1. Products: prices and features
1.1 Unless otherwise indicated, the prices of Products published by TUNINETTI PNEUMATICI SRL must be understood as inclusive of VAT. from time to time published by TUNINETTI PNEUMATICI SRL cancel and replace the previous ones and are subject to the actual availability of the Products. TUNINETTI PNEUMATICI SRL reserves the right to confirm or change the prices of the Products published on its website or in information brochures and advertising material, upon confirmation of the Customer's order.
1.2 The technical and functional characteristics related to the Products published by TUNINETTI PNEUMATICI SRL through their own promotional messages and information brochures are those communicated by the respective producers. TUNINETTI PNEUMATICI SRL assumes no responsibility for the veracity and completeness of this information. Unless otherwise indicated, the manuals and Software related to the Products are in English. The images of the products are indicative and not binding.
1.3 The Products are not supplied on trial. Although the TUNINETTI PNEUMATICI SRL operators can provide indications on the characteristics of the Products, the Customer is responsible for the selection of the Products ordered and for the compliance and conformity of the specifications indicated by each manufacturer to their needs.


2. Orders - billing
2.1 All purchase orders of Products transmitted to TUNINETTI PNEUMATICI SRL must be complete in their entirety and must contain all the elements necessary for the correct identification of the Products ordered. Each order of Products sent to TUNINETTI PNEUMATICI SRL constitutes a contractual proposal of the Customer and, therefore, will be binding for TUNINETTI PNEUMATICI SRL only if confirmed by acceptance. The execution of the order by TUNINETTI PNEUMATICI SRL , is equivalent to confirmation and acceptance of the same.
2.2 TUNINETTI PNEUMATICI SRL reserves the right not to accept incomplete orders, not properly completed.
In case of non-execution of the order by TUNINETTI PNEUMATICI SRL (if the same is due to unavailability of the Products ordered by the Customer) TUNINETTI PNEUMATICI SRL will inform as soon as possible the Customer, reimbursing the sums already paid by them of the supply not performed. In this case the Customer will not be entitled to any reimbursement or compensation or indemnity of any kind. 2.3 According to article 1, paragraph 1 of the Ministerial Decree of 21/12/1992, mail order sales are free from the issue of fiscal documents (receipt, invoice, etc.). The customer obtains a document to accompany the goods containing information relating to the contract. This document must be kept as proof of purchase to which reference should be made for any dispute or problem concerning the shipment. If the Customer holds a VAT number and wishes to receive an invoice in his own name, he must indicate this request in the order. Failing this , TUNINETTI PNEUMATICI SRL will not issue a tax invoice.

3. Delivery of Products
3.1 All costs of delivery of the Products are charged to the Customer. In case of deliveries by courier, delivery of the Products is subject to payment by the Customer of the relative price in cash or by bank or circular check. TUNINETTI PNEUMATICI SRL has the right, at its sole discretion, to deliver the Products ordered by a courier other than GLS or by other means that it deems appropriate. Unless otherwise indicated, all deliveries are made to the street level.
3.2 The delivery terms indicated by TUNINETTI PNEUMATICI SRL refer to the Products present in their warehouses and, although carefully evaluated, must be considered non-binding for TUNINETTI PNEUMATICI SRL , which may subsequently confirm or modify them, depending on their actual availability. In exceptional cases we reserve the right (for example non-availability of goods) to terminate the contract. In this case the customer will be contacted immediately also to propose possible alternatives. Any delays in deliveries of less than 30 (thirty) days do not entitle the Customer to refuse the delivery of the Products, nor to claim compensation or indemnity of any kind.
3.4 TUNINETTI PNEUMATICI SRL has the right to carry out the delivery of the Products (also relative to the same order) in several successive deliveries without prejudice, in this case, a single charge to the Customer as transport costs.
3.5 Special terms and conditions of delivery must be agreed in advance between the Customer and TUNINETTI PNEUMATICI SRL and accepted in writing by TUNINETTI PNEUMATICI SRL .
3.6 At the time of delivery of the package the customer is required to check its integrity and report immediately to the carrier any anomalies found on the package (open package or dented) and possibly check the contents in the presence of the shipper. The customer will also be required to notify TUNINETTI PNEUMATICI SRL .

4. Special offers and gifts
4.1 Any special offers promoted by TUNINETTI PNEUMATICI SRL are valid until the stocks are exhausted and, in any case, are subject to the actual availability of the related Products by TUNINETTI PNEUMATICI SRL . The special offers available can not be combined. The products in gift or in special offer could be in promotional packs (for packages means boxes, online manuals, etc.)
4.2 If a special offer promoted by TUNINETTI PNEUMATICI SRL foresees the sending of a free product together with one or more products purchased, the Customer will be entitled to this free product only if the same has been expressly requested by the Customer in the order sent to TUNINETTI PNEUMATICI SRL and until the stock is depleted .
4.3 No assistance or replacement is provided in relation to any products received as a gift from the Customer.

5. Product Warranties - Technical Assistance
5.1 TUNINETTI PNEUMATICI SRL does not lend on the Products any guarantee other than that provided by the individual manufacturers. Technical assistance and warranty interventions on the Products are carried out, where provided, by the individual producers, according to the terms and procedures indicated in the documentation attached to the Products themselves. In particular, TUNINETTI PNEUMATICI SRL does not give any guarantee regarding the compatibility of the Products with other products or equipment used by the Customer, nor does it provide any guarantee regarding the suitability of the Products for the specific use envisaged by the Customer. Since some products sold are used in sport at risk (for example: alpine sports, ski tours, etc.), TUNINETTI PNEUMATICI SRL assumes no responsibility for the non-specialized use of these products. For this reason, before using these products, we recommend that you carefully read the instructions for use or acquire information from expert personnel.
5.2 It is already agreed that, if the liability of TUNINETTI PNEUMATICI SRL is ascertained in any way towards the Customer - including the case of the total or partial non-fulfillment of the obligations assumed by TUNINETTI PNEUMATICI SRL towards the Customer as a result of the execution of an order - the liability of TUNINETTI PNEUMATICI SRL may not exceed the price of the Products purchased by the Customer and for which the dispute arose.

6. Right of withdrawal
6.1 Pursuant to art. 5 of Legislative Decree 22 May 1999 n. 185, the Customer (if it qualifies as a "consumer" pursuant to Article 1 letter b) of Legislative Decree 22 May 1999 n. 185) has the right to withdraw from the contract and return the Products ordered, without any penalty and without specifying the reason, within 10 (ten) working days from receipt of the Products.
6.2 The right of withdrawal referred to in Article 6.1 above must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter to TUNINETTI PNEUMATICI SRL - VIA CIRCONVALLAZIONE, 3 - 12030 CASALGRASSO (CN) within 10 (ten) ) working days from receipt of the Products. The above communication can be sent, within the same term, to TUNINETTI PNEUMATICI SRL at the email amministrazione@tuninettipneumatici.com , provided that it is confirmed, by registered mail, within 48 (forty eight) hours after sending the telegram or fax.
6.3 All returns (which must be perfectly intact and accompanied by the original packaging) must be authorized by the TUNINETTI PNEUMATICI SRL Customer Service which will issue a return authorization number (RMA). Once the RMA number has been received, the Customer can send the Product back to the following address: TUNINETTI PNEUMATICI SRL - VIA CIRCONVALLAZIONE, 3 - 12030 CASALGRASSO (CN) No cash on delivery parcels will be accepted.
6.4 Once received the Products (and verified their integrity) TUNINETTI PNEUMATICI SRL will, as soon as possible, to credit the Customer for the cost of the returned Products (as indicated on the invoice), withholding the amount of shipping costs that will remain permanently charged to the customer.


6.5 The right of withdrawal referred to in Article 6.1 above can not be exercised by the Customer in the following cases:
a) the goods have been tailor-made or clearly customized (goods sold in meters, skis, etc.)
b) if the goods by their nature can not be returned or if they are likely to be deteriorated or altered rapidly
c) if the goods have been opened by the consumer (for example if the items purchased consist of audiovisual or sealed computer software, which have been opened by the Customer)
d) in the case of books, magazines or geographical maps
e) if it is underwear (for reasons of hygiene)
f) if tags or labels have been removed from the products themselves
g) if its condition or quality has been influenced by the consumer (for example dirty or damaged articles)


7. Competent court
Without prejudice to the possible applicability of mandatory provisions of law to protect consumers (as defined under Article 1 letter b) of Legislative Decree 22 May 1999 n. 185), any dispute in any case connected to these General Conditions will be devolved to the exclusive jurisdiction of the Court of CUNEO Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and understood and to accept specifically the following clauses of the General Conditions of Sale TUNINETTI TNEINATICHE SRL : 1.1, 1.2, 2.1, 2.2, 3.2, 4.1, 4.2, 4.3, 5.1, 5.2, 6.2, 6.3, 6.4, 6.5 and 7
